1. GENERAL CONSIDERATIONS

1.1. Contracting Parties

S.C. COSROM COSMETICS S.R.L., a Romanian limited liability company, registered with the Trade Registry under No. J40/7321/2003 and having the unique registration code RO15475458, headquartered at Str. Dantelei No. 90A, Sector 5 - Bucharest, and with a business office and correspondence address at Str. Londra No. 22, Sector 1 - Bucharest, the administrator of the Site, hereinafter referred to as the "Company." and the person who uses the website www.casiani.ro (hereinafter referred to as the "Site") and/or the Services offered by the Company according to the specifications mentioned on the Site, hereinafter referred to as the "User."

Referred to collectively as the "Contracting Parties" or "Parties."

1.2. Objective

The objective of the Site is to present and offer to customers for personal use the Products and Services provided by the Company in accordance with their description on the Site.

1.3. Definitions

1.3.1. General Definitions Content: All information presented on the Site (for example and without limitation: images, films, texts, graphic symbols, and/or soundtracks). Property Rights: All images, texts, films, illustrations, and graphic symbols presented on the Site. Contract: The distance contract concluded between the Company and the User/Buyer. Buyer: An individual over 18 years of age or a legal entity who, as a User or at the direction of another registered User, pays for the products/services ordered. Product/s: Goods with characteristic details specified on the Site. Price: The value of the Product or Services ordered by the User/Buyer. Services: The services offered by the Company through the Site. Warranty: Commitment assumed by the Company towards the Buyer, additional to the legal provisions in force. Product Maintenance Recommendations: Instructions for use/maintenance of the product/products communicated on the Site. Quality/Warranty Certificate: Information presented on the site to authenticate the product/products or, where applicable, its/their components. Delivery: Information presented on the site regarding the methods of delivery of the ordered product/products. Return: Information communicated on the site regarding the acceptance of the return of a purchased product. Gift Card/Voucher: A card delivered electronically and/or physically upon request, offering the holder the possibility of purchasing products from the Site. Showroom: The Casiani store at Str. Londra No. 22, Sector 1 - Bucharest.

 

1.3.2. Site Section Definitions

  • "Welcome!": A section of the Site where the User provides personal information to purchase products/use services presented on the Site and allows the Company to communicate and deliver these products/services according to the User's preferences.
  • Favorites: A section of the Site that allows the User to mark preferred products.
  • Shopping Cart: A section of the Site where the Products selected by the User for purchase are added.
  • Order: A form sent to the Company to process the User's order.
  • Order Receipt Confirmation: A confirmation process sent by the Company to the User, indicating that the order has been received.
  • Order Acceptance: Confirmation from the Company sent to the User that the placed order is accepted.
  • Legal: A section of the Site where the Terms and Conditions, Privacy Policy, and Cookies Policy are detailed.
  • Services: A section of the Site where the services offered by the Company are detailed.
  • Company: A section of the Site that presents ways to contact the Company, job opportunities within the Company, and the social activities in which the Company is involved.
  • Useful Information: A section of the Site where various information that may be useful to the User in the decision-making process of purchasing a Product is presented.
  • Payment Methods: The payment instruments accepted by the Company.
1.4. Accessing/Using the Site and the Content/Information Presented

1.4.1. Accessing/using the content and services of the Site can be done in accordance with these Terms and Conditions and the applicable laws. We recommend reading the Terms, conditions, and policies presented on the Site carefully before use. These will be considered as fully accepted when using the Site.

1.4.2. The Company reserves the right to modify the terms, conditions, and policies presented on the Site without prior notice, in compliance with the applicable laws. Therefore, we recommend checking their status each time you access the Site.

1.4.3. If you do not agree with the current terms, conditions, or policies presented on the site, please do not access/use the Site or, if you are already a user, cease accessing/using the Site.

2. PROPERTY RIGHTS

The Site and its entire content: films, illustrations, images, articles, symbols, and graphic elements, as well as the soundtrack, are the property of the Company or its shareholders, representing registered or unregistered trademarks, in which case usage rights (copyright) have been obtained in advance. The Company reserves the right to act in accordance with the applicable laws in case of use/reproduction or alteration of any aforementioned element (for example and without limitation: text/symbol/graphic element/image/film/soundtrack) without the written consent of the Company or, where applicable, the rightful owner of the content used for purposes other than personal, non-commercial use and in a context other than that intended by the Company.

In the event that the User has obtained prior written consent from the Company to use certain content elements of the site, they agree and commit to:

  • Use the usage rights according to the purpose, in the context for which they were created and respecting the terms under which they were granted by the Company.
  • Cease using/presenting them upon expiration of the term for which they were granted.
 

3. ONLINE SALES

3.1. Product

Jewelry, leather goods, and textile articles are presented on the Site for sale in compliance with applicable legislative norms.

3.1.1. The Company makes every effort to provide accurate information about the Products presented on the Site, but does not exclude the possibility of human errors.

3.1.2. The Company communicates and the User acknowledges that:

  • The image of each Product presented on the site is a real image of the Product/model of the Product sold, but it may be perceived differently depending on the characteristics/settings of the device used when accessing the Site.
  • The stones in the Products in the jewelry category are natural, and as such, there may be differences in appearance between Products of the same type/model.
  • Products in the "Leather Goods" category are made of natural leather, and as such, there are differences in appearance between Products of the same type/model. During the Order confirmation procedure (Chapter 3 - Article 3.3.5), the Company's representative will inform the Buyer in detail about these aspects.
3.1.3. If an ordered Product has erroneous characteristics compared to its presentation on the Site due to a human or technical error, the Buyer will contact the Company (by phone or email as detailed on the Site) within 24 working hours of receiving the order to report the discrepancy. The Company will make every effort to deliver a similar new Product after the Buyer returns the initially delivered Product. If this resolution is not accepted by the Buyer, the Company reserves the right to cancel the Order.

3.2. Price

The price of the products presented on the Site is expressed in lei and includes value-added tax (VAT). The Company reserves the right to update the price/prices of a product/products at any time without prior notice. In this event, the valid price of a product/products for orders in the process of processing/shipping will be the one applied at the date of their placement. The Company makes every effort to provide accurate information about the price of the Products, but does not exclude the possibility that, due to human error, the price of a particular product is presented incorrectly. If the Buyer places an order for a Product whose price is displayed incorrectly, the Company reserves the right to cancel the order, not before contacting the Buyer as mentioned in Article 3.3, paragraph 3.3.4.

3.3. Ordering on the Site

3.3.1. An order on the Site can be placed by an individual user over 18 years of age or a legal entity by adding the desired Products to the shopping cart and making the payment after selecting one of the payment options accepted by the Company. The Product/Products in the shopping cart are available for sale within the stock held by the Company. It is not necessary for the User to register an account on the Site to place an order.

3.3.2. Reserving a specific Product/Products can be done by contacting the Company via email, phone (details displayed on the Site). Simply adding a Product/Products to the shopping cart without finalizing the order is not considered a reservation of those Products.

3.3.3. The User/Buyer is responsible for the accuracy of the contact details provided and the actions taken in relation to the Site's content. An individual user acting on behalf of a legal entity Buyer declares that they have the consent of the latter's administrator to place the order and pay the price for purchasing products and is directly responsible for any damages suffered by the Company as a result of the User's culpable actions.

 

3.3.4. Receiving the order price via bank transfer from the User/Buyer does not imply acceptance of the order and the obligation for the Company to deliver if:

  • The information in the order form is incomplete/incorrect.
  • The provisions of the applicable legislation are not respected (e.g., cash payment limits).
  • The price of a product presented on the Site is incorrectly listed due to an error, in which case a Company representative will contact you, and you will either be refunded the overpaid amount if the listed price is higher than the actual price, or you will be asked to pay the difference if the listed price is lower than the actual price if you choose to proceed with the order. If not, the amount paid will be refunded as soon as possible.
  • The status of the ordered product(s) on the Site is incorrectly listed as available in stock due to an error, in which case a Company representative will contact you to resolve the issue either by proposing similar products, communicating the availability date, or refunding the amount paid if the first options are not accepted by the User/Buyer.
  • The Company has knowledge of suspicions of fraud or tax evasion, in which case the amount paid will be refunded.
3.3.5. The Parties can communicate to ensure the smooth processing/delivery of an order placed/received by accessing the information provided on the Site for the Company and provided by the User (e.g., email address, phone number). As a procedure, after placing the order on the Site, the Buyer will be contacted by phone or email by a Company representative for confirmation.

3.3.6. Order processing is done during working hours (Monday - Friday between 9:00 AM - 6:00 PM) within a maximum of 2 working days. Working hours may change during holidays and vacations, in which case the information will be published on the Site. Product delivery is made within a maximum of 7 days (usually 2 days) after confirming the receipt of the due amount in the Company's account. For advance payments made via bank transfer, the delivery term starts from the moment the full amount is received in the Company's account.

3.4. Payment Methods

3.4.1. The value of the order on the Site can be paid:

 

ONLINE PAYMENT

For the safety of your payments, we use NETOPIA mobilPay as our card processor. Payments are secured according to the 3D Secure VISA and MasterCard standards.

If you selected credit/debit card as the payment method, a page will automatically open where you need to complete the form with your card details. If the card transaction is successful, you will receive a message with relevant information about your order. This information will also be sent to you by email.

The following credit/debit cards are accepted: Visa, Visa Electron, Mastercard/Eurocard, Maestro, including virtual Visa or MasterCard cards. The ordered products must be paid in full; otherwise, we will not be able to deliver the products to you.

 

 

CASH

Accepted strictly in accordance with the legal provisions in force.

BANK TRANSFER

In this case, the payment must be made from the bank account of the person whose details are registered as the Buyer. Otherwise, the Company reserves the right not to honor the order.

  • Online payment through the secure payment service provided by Netopia.
3.4.2. In the case of payments made by bank transfer, the refusal by the issuing bank of the payment instrument used to accept the payment leads to the cancellation of the order, and the Company is exonerated from any other obligation.

3.5. Invoice / Receipt

The invoice for the ordered Products will be issued at the end of the Order processing and sent to the Buyer at the address indicated by them in the Order form. In the case of cash payments, the receipt proving the payment of the goods will be issued at the time of payment.

4. DELIVERY

Product delivery is done either by direct pickup by the Buyer from the Casiani showroom, through the Company's representatives, or through partner courier companies. The Company ensures the proper packaging of the ordered Product(s) for delivery to the Buyer along with the necessary delivery documents, using the data provided by the Buyer in the order form.

4.1. Product delivery is made within a maximum of 7 days (usually 2 days) after confirming the receipt of the due amount in the Company's account. For payments made in advance by bank transfer, the delivery term starts from the moment the full amount is received in the Company's account.

4.2. If the Buyer is not present at the specified address during the prearranged time with the partner courier company, the delivery agent will attempt to deliver the products again. If delivery cannot be made this time either, the order will be canceled and returned to the Company, with the costs of the new delivery to be borne by the Buyer.

4.3. The Company will not be held responsible for any delays in delivering an order due to reasons beyond its control (force majeure, delays caused by partner courier companies) and will not be held liable for any damages suffered by the Buyer due to these possible delivery delays.

4.4. If an Order sent by the Company to the Buyer's address is not received by the Buyer due to the fault of the courier company's representatives, the Buyer will inform the Company, and the Company will take all necessary steps to resolve the issue as soon as possible.

 

5. RETURNS

Products made to order, customized, or modified at the Buyer's request are not accepted for return, in accordance with the legislation in force.

5.1. The return of the Product(s) ordered on the Site and the reimbursement of their value can be made within a maximum of 14 calendar days from the date of receipt. Please inform us of your decision in this case by written notification to the email address: office@casiani.ro. The return request will be made by the Buyer.

5.2. The return of Product(s) purchased directly from the Showroom can be done strictly under the conditions provided by the legislation in force. The Product(s) can be exchanged for another Product(s) of at least equal value to the initial purchase within 24 hours from the time of purchase, in which case, if applicable, the Buyer will pay the difference in value.

5.3. The Product will be accepted for return if the following criteria are simultaneously met:

  • it shows no signs of wear
  • it has no defects caused by improper handling
  • it is accompanied by the original packaging, a copy of the purchase documents (invoice/receipt), and the original quality and warranty certificates relevant to the purchase subject to the return process.
Upon receiving the returned product, the Company will conduct a thorough analysis of the Product(s) condition, and following the analysis, a return report will be drawn up. The Company will communicate the findings to the Buyer within 7 days.

5.4. In accordance with the provisions of OUG 34/2014 - regarding consumer rights in contracts concluded with professionals, as well as for the amendment and completion of some normative acts, the transport costs for the returned product are borne by the Buyer. Therefore, we suggest carefully packing the product you wish to return, so it is well protected during transport; any damages will lead to the exoneration of the Company's responsibility in the mentioned context.

5.5. The Company will reimburse the Buyer for the value of the products accepted for return at the initial purchase value within a maximum of 7 calendar days from the date of the Company's evaluation of the product returned by the Buyer into the bank account from which the online payment was initially made.

5.6. Gift cards or vouchers purchased are not accepted for return.

5.7. The Company reserves the right to refuse acceptance of returns in cases of abuse (repeated returns).

6. QUALITY CERTIFICATE / WARRANTY

For all Products sold by the Company on the Site, you benefit from warranty certificates according to the legislation in force. To benefit from the warranty, the buyer is required to present the invoice / receipt attesting to the purchase together with the Quality and Warranty Certificate issued by the seller.

6.1. All jewelry sold by the Company has been subject to control by the National Authority for Consumer Protection (ANPC) - Precious Metals Department, marked with the state mark, responsibility mark, and corresponding title mark: gold 585 (14k), 750 (18k), 950 (Platinum), and 925 (Silver). In the case of Products in the "Jewelry" category, the term "warranty" attests that the jewelry is made of the metal mentioned in the certificate and does not change its properties when used appropriately for the purpose for which it was designed. The warranty certificate issued attests to the authenticity and quality of the purchased jewelry, ensuring consumer rights in accordance with OG no. 21/1992 and Emergency Ordinance no. 140/2021. The warranty claim conditions for Products in the "Jewelry" category comply with the current legislative norms.

6.2. In case of a manufacturing defect, the product will be repaired free of charge within 15 days under the conditions of art. 12 para. 1) letter b) of Emergency Ordinance no. 140/2021 or will be replaced in the event that repair is not possible, in which case an identical product is not guaranteed, but one with equivalent value.

6.3. Products in the "Leather Articles" category benefit from warranty certificates in compliance with the current legal norms.

6.4. The warranty certificate becomes void in the following situations:

  • Loss of the invoice / receipt related to the purchase and/or the Quality and Warranty Certificate
  • Product damage due to:
     
    • Non-compliance with the recommendations mentioned in the Quality and Warranty Certificate issued
  •  
    • Improper use / handling / storage
  •  
    • Loss / breakage of stones from the product's setting
  •  
    • Alteration / modification in any form of the initially purchased product
  •  
7.    MAINTENANCE RECOMMENDATIONS FOR PRODUCTS

General recommendations: Use the product according to its intended purpose.

Specific recommendations for JEWELRY:

  • Store the Product in its original packaging or specific boxes designed for jewelry.
  • Avoid mechanical shocks (e.g., impacts) that may lead to damage to the Product.
  • Avoid exposing the Product to high temperatures, steam, water, chemicals (e.g., perfume, cleaning agents, hairspray), sweat; these factors can affect the stones and organic components of the materials.
  • We do NOT recommend using standard cleaning substances for the Product that contain organic materials (pearls / mother-of-pearl / coral).
  • Avoid wearing the Product during physical / household / rough activities or those where there is a possibility of contact with substances containing sulfur / chlorine.
  • Periodically wipe the Product with a soft cloth to maintain its original shine, but do not rub its surfaces or crystals / stones; do not clean with water, cleaning solutions, alcohol.
  • Avoid forcing the closure carabiner of chains, bracelets, necklaces, as well as the closure system of earrings.
  • We recommend that the Product be examined and cleaned by a specialist at least once a year.
Specific recommendations for LEATHER ITEMS: Although exotic leather is recognized and appreciated for its durability, to maintain its value and longevity, it is important to:

  • Avoid excessive exposure to water, as this can cause staining and cracking of the leather as it dries out.
  • If the Product has been exposed to water, make sure to gently dry it with a clean cloth until most of the water is removed. Once you have removed the surface water, place the Product in a cool indoor space to dry.
  • Do not place the Product in direct sunlight or heat, as this can lead to cracking of the leather and discoloration over time.
  • Store the Product in a cool, dry space.
  • Keep the Product in the packaging it was delivered in; this will protect it from dust and other harmful particles.
  • Periodically clean the Product using a clean, slightly damp cloth, in a circular motion. Make sure to remove as much moisture as possible and allow the Product to dry completely in a cool area after cleaning.
Specific recommendations for TEXTILE ITEMS: The textile products featured on the site are made from carefully selected high-quality fabrics. We recommend professional dry cleaning. Recommendations for products containing Cashmere:

  • Never wash cashmere at temperatures higher than 20°C to maintain the shape of the Product and avoid shrinkage.
  • If using a washing machine, use the wool program with a temperature of up to 20°C.
  • For hand washing, do not wring out the Product; it is preferable to use the spin program of the washing machine at a maximum of 1000 RPM (rotations per minute).
  • In the washing process, it is preferable to use baby shampoo or a detergent intended for wool products.
  • Use a specific Cashmere Product brush to remove lint.
  • Do not dry the Product in direct sunlight or in a dryer.
  • Do not iron the Product.
8.    PRIVACY POLICY AND PROCESSING OF PERSONAL DATA
By using the Site to create an account, fill out a contact form, or place orders, the User understands and declares acceptance of being contacted by the Company and that the provided data will be processed in the Company's database for the purpose of improving services and commercial relationships. The Company respects the privacy and security of processing personal data of each person who visits or orders products on the Site in accordance with the requirements of Law no. 677/2001 regarding the protection of individuals concerning the processing of personal data and the free movement of such data. For detailed information, please refer to and we recommend consulting the following policies published on the Site:

  • Cookie Policy displayed on the Site (LEGAL section)
  • Privacy Policy displayed on the Site (LEGAL section)
9.    APPLICABLE LEGISLATION, JURISDICTION, AND FINAL PROVISIONS

 Any other aspect not already presented in any article of this document will be resolved amicably within 30 working days from the date of written notification of the issues by the user. In case the conflict cannot be resolved amicably, the jurisdiction belongs to the Romanian courts, with the Company choosing the jurisdiction of the courts in the municipality of Bucharest. By agreeing to this Contract, the Company and the client fully assume these risks.
